Impact of Brexit on UP/UPC

On 12 July, the government released its White Paper addressing its plan for exiting the EU. It includes a positive statement that the UK intends to explore staying in both the Unified Patent Court (UPC) and the unitary patent (UP) system after the UK leaves the EU. The UK government will work with the other contracting states so that users will be able to benefit from the streamlined system for enforcing patents through a single court that is provided by the UPC.

We now await the results of the constitutional challenge in Germany to see when the UP/UPC will come into force. More information will follow as soon as possible.
